Calculation Methodology & Statutory Rules
Calculates End of Service Benefits (EOSB) under UAE Federal Decree-Law No.
33 of 2021.
Total continuous service days = (Years * 365.25) + (Months * 30.4375) - Unpaid Leave Days.
Total service years = Total service days / 365.25.
If total service < 1 year (365 days), Gratuity = 0 AED.
Daily Basic Wage = (Basic Salary * 12) / 365.
For the first 5 years of service, Gratuity = Total Service Years (up to 5) * 21 * Daily Basic Wage.
For service exceeding 5 years, Gratuity = (5 * 21 * Daily Basic Wage) + ((Total Service Years - 5) * 30 * Daily Basic Wage).
Maximum Gratuity cap = 24 * Basic Monthly Salary (2 years' basic pay).
Under Federal Decree-Law No.
33 of 2021, resignation does not reduce gratuity entitlement percentages after 1 year of service.
Frequently Asked Questions
Q1.How is UAE End of Service Gratuity (EOSB) calculated under Federal Decree-Law No. 33 of 2021?
For employees completing at least 1 year of continuous service in the UAE private sector, gratuity equals 21 days of basic wage for each of the first 5 years of service, plus 30 days of basic wage for each additional year thereafter. The maximum total gratuity is capped at two years' basic salary.
Q2.Does resignation reduce gratuity entitlements under the new UAE Labor Law?
Under UAE Federal Decree-Law No. 33 of 2021, the distinction between limited and unlimited contracts was standardized. Employees who resign after completing at least 1 year of service are entitled to 100% of their calculated end-of-service gratuity without previous statutory reductions.
